										<content:encoded><![CDATA[<p>Cargo theft continues to climb year after year, and the U.S. Department of Transportation (DOT) is now asking truck drivers and other industry professionals to weigh in on how to stop it.</p>
<h2><strong>Cargo Theft Losses Continue to Climb</strong></h2>
<p>The numbers paint a troubling picture. According to CargoNet, a New Jersey-based logistics security firm, theft-related losses jumped 13% in the second quarter of 2025 compared with the same period in 2024. In just three months, the losses were valued at more than $61 million.</p>
<p>The National Insurance Crime Bureau has also raised concerns. The group is projecting a 22% year-over-year rise in losses this year, fueled in part by increasingly sophisticated theft methods and cyber-enabled attacks targeting the supply chain.</p>
<h3><strong>DOT Seeks Feedback from the Industry</strong></h3>
<p>To address the problem, the DOT issued a request for information on September 19. The department is inviting feedback from truckers, carriers, law enforcement, federal partners, and others who play a role in protecting freight.</p>
<p>“These crimes involve opportunistic ‘straight thefts’ of trailers, containers, and loads at truck stops or multimodal distribution hubs and highly coordinated operations conducted by organized criminal networks,” the DOT explained. “Both categories create significant economic losses, disrupt supply chains, and in some cases fund broader illicit activities such as narcotics trafficking, counterfeiting, and human smuggling.”</p>
<p>The department is asking for insight on:</p>
<ul>
<li>Which commodities are most at risk?</li>
<li>The types of theft scenarios drivers and carriers are seeing most often.</li>
<li>The technologies and practices already being used to reduce exposure.</li>
</ul>
<h3><strong>Possible Steps Forward</strong></h3>
<p>Officials say the responses will help shape next steps. The DOT noted that public input could guide efforts to:</p>
<ul>
<li>Work with law enforcement to close regulatory gaps that allow unsafe carriers to re-enter under new names.</li>
<li>Strengthen how cargo theft risks are assessed by using shared data from federal, state, and industry partners.</li>
<li>Expand coordination with Homeland Security, FBI, Customs and Border Protection, and local agencies.</li>
<li>Build new initiatives with industry stakeholders to reduce losses and improve supply chain security.</li>
</ul>
<h4><strong>How to Get Involved</strong></h4>
<p>The public comment period is open for 30 days. Drivers, carriers, and other stakeholders can submit feedback online at <a href="https://www.regulations.gov/">Regulations.gov</a> by referencing Docket No. DOT–OST–2025–1326. All <a href="https://www.regulations.gov/commenton/DOT-OST-2025-1326-0001">comments</a> must be submitted by October 20, 2025.</p>

										<content:encoded><![CDATA[<p>The Federal Motor Carrier Safety Administration (FMCSA) has announced a proposal to push back the enforcement date of its broker financial security requirements to 2026.</p>
<p>This proposed rulemaking, which recently appeared in the Federal Register, suggests extending the compliance deadline from January 16, 2025, to January 16, 2026. The extension aims to coincide with the anticipated readiness of FMCSA&#8217;s updated registration system.</p>
<p>“This action is being proposed because FMCSA has determined that only its forthcoming online registration system will be used to accept filings and track notifications, and this functionality will not be added to its legacy systems,” the agency wrote in the notice. “As the new system is not expected to be available before Jan. 16, 2025, FMCSA proposed to extend the compliance date to provide regulated entities time to begin using and familiarizing themselves with the system before compliance is required.”</p>
<h2><strong>Overview of the Rule</strong></h2>
<p>The finalized regulations concerning broker and freight forwarder financial security were released by FMCSA in November 2023. These regulations aim to tighten security measures within the brokerage industry, notably suspending operating authority if financial security dips under $75,000.</p>
<p>Key aspects of the rule include:</p>
<ul>
<li>Restricting the types of assets that can be held in broker or freight forwarder trusts to cash, treasury bonds, and irrevocable letters of credit from federally insured institutions.</li>
</ul>
<ul>
<li>Outlining the procedures for the immediate suspension of broker or freight forwarder operational authority should their financial security fall below the $75,000 threshold.</li>
</ul>
<ul>
<li>Defining criteria for financial failure or insolvency among brokers and freight forwarders, and specifying the resultant obligations.</li>
</ul>
<ul>
<li>Revising FMCSA regulations to introduce civil penalties for violations by sureties and trust funds, and establishing a suspension process for non-compliance.</li>
</ul>
<p>Originally, brokers, sureties, and financial service providers were expected to adhere to these suspension protocols starting January 16, 2025, with additional rule components slated for 2026 implementation. The FMCSA now proposes a one-year deferment of the suspension rules.</p>
<h3><strong>Participating in the Commentary Process</strong></h3>
<p>Following publication in the Federal Register, there will be a 15-day window for public comments on the proposed delay. Interested parties can submit their feedback by visiting Regulations.gov and entering the docket number FMCSA-2024-0280.</p>
