<p>In response to intensifying wildfire conditions, Washington state has enacted an emergency fuel delivery waiver. The state&#8217;s proclamation, issued on Friday, August 2, reveals, “Multiple new and ongoing wildfires throughout Washington, resulting from a prolonged hot and dry climate combined with wind and fire-fuel conditions, (have) created an active burning environment challenging the availability of limited firefighting resources throughout the region.” To address potential fuel shortages impacting firefighting efforts, the state has temporarily relaxed hours-of-service regulations for commercial fuel transport vehicles across Washington.</p>
<p>The emergency order underscores the urgency, stating, “The large number of fires in the Pacific Northwest has created a large-scale fuel supply shortage for firefighting activities in the Western United States.” Access to sufficient fuel is pivotal for effective firefighting strategies, especially as ongoing wildfires rapidly deplete available resources. As of now, reports from Washington’s Department of Natural Resources reveal that wildfires have scorched a staggering 252,782 acres and continue to pose considerable challenges, with six major fires still burning.</p>
<p><strong>Fire Reports and Evacuations</strong></p>
<p>Among the active wildfires, the Pioneer fire near Stehekin, WA, has triggered Level 3 evacuation orders, while North Cascades Highway remains closed with no reopening timeline yet available.</p>

<p>The wildfire crisis isn&#8217;t confined to Washington alone; neighboring Oregon has declared its own state of emergency since mid-July, which extends to August 26. The Oregon Department of Forestry indicates that as of Monday, August 5, there are 31 major active fires, ravaging approximately 1,387,541 acres. Additionally, in Canada, provinces such as British Columbia and Alberta have declared wildfire emergencies, set to last until August 31, including the largest wildfire in a century within Jasper National Park.</p>

										<content:encoded><![CDATA[<p>The Federal Motor Carrier Safety Administration (FMCSA) has initiated the public comment phase for an exemption application concerning rear-vision mirrors. Convoy Technologies is seeking approval for their electronic rearview system to replace the two traditional rear-vision mirrors mandated by the FMCSA on commercial motor vehicles (CMVs).</p>
<p>“Currently mirrors meeting or exceeding the required Federal Motor Vehicle Safety Standard No. 111 specifications are often used by roadside inspectors and law enforcement officers to see what is happening inside the cab,” the CVSA wrote in 2018 about a similar mirror exemption request. “For example, a passing enforcement official can see whether the driver has remained in the driver seat; a safety concern for inspectors.”</p>
<p>Federal regulations require all CMVs to be equipped with a rear-vision mirror on each side, offering drivers a comprehensive view of the highway behind and the surrounding areas on each side of the vehicle.</p>
<p>“Similarly, roadside inspectors use mirrors to identify when CMV drivers are operating a vehicle in an unsafe manner, such as while using a handheld device or not wearing a safety belt,” CVSA wrote. “Without status quo style mirrors, feasibility of current enforcement methods for these and related laws and regulations may be affected.”</p>

<p>“The mirrors are a failsafe design, especially if you have mirrors mounted on the hood of your vehicle,” wrote truck driver Joseph Gavalis. “Just another reason to remove your eyes from the road and look down at your dashboard monitor. The mirrors keep your head up towards the windshield. The only reason they are supporting these cameras is to make money. … Too much technology is not always a good thing.”</p>
<p>It&#8217;s noteworthy that the FMCSA has previously granted exemptions for similar requests from Rosco Vision, Robert Bosch LLC, and Stoneridge. However, concerns have been raised by the Commercial Vehicle Safety Alliance (CVSA) and other stakeholders regarding the implications of such exemptions.</p>

										<content:encoded><![CDATA[<p>The Federal Motor Carrier Safety Administration (FMCSA) has finalized its decision to extend a waiver from the electronic logging device (ELD) mandate for the Motion Picture Association (MPA). This waiver applies to all drivers involved in transporting to or from theatrical or television motion picture production sites, allowing them to use paper logs instead of ELDs.</p>
<p>The provisional renewal of MPA&#8217;s waiver in November 2022, subject to public comments, has now been officially approved. Following the agency&#8217;s review of the four received comments, it concluded that the waiver maintains an equal or higher level of safety compared to adhering to the ELD mandate.</p>
<p>Initially granted in 2018, MPA&#8217;s request for renewal highlighted that approximately 8,300 Commercial Motor Vehicle (CMV) drivers, working either full- or part-time for the motion picture industry, face challenges in qualifying for short-haul driver exceptions in Hours of Service (HOS) regulations. MPA emphasized that these drivers spend an average of two hours driving daily, covering approximately 40 miles.</p>
<p>Given the unique nature of their work, MPA stated that the logs generated by these drivers, as well as the HOS records maintained by motor carriers, are intricate. However, through collaborative efforts, the industry has effectively managed the exchange of paper logs required by this work pattern.</p>
<p>MPA emphasized that the success in HOS management within the industry is based on a driver-centric system rather than vehicle-based. Each time a driver operates a CMV for a different studio or production company, there&#8217;s a need to reconcile the driver’s HOS record for the past week, which involves handling necessary paper logs. This practice is integral to the industry&#8217;s operations, allowing drivers to produce paper logs during roadside inspections for enforcement officials&#8217; review.</p>
<p>FMCSA has renewed the waiver for five years, effective from Jan. 19, 2023, through Jan. 19, 2028. This decision acknowledges the industry&#8217;s unique operational requirements and ensures continued compliance with safety regulations while allowing for the use of paper logs.</p>
