Late last week, on Feb. 29, the Federal Motor Carrier Safety Administration (FMCSA) officially made an announcement regarding the revocation of certification for five electronic logging devices (ELDs) from its registered ELDs list. The affected devices are as follows:
- CI ELD Logs from CV Options LLC
- CN ELD from ELD Connection
- KSK ELD from KSK Group, Inc.
- TT ELD 30 from TT ELD Inc.
- TT ELD 1010 from TT ELD Inc.
It is noteworthy that both the KSK ELD and the CI ELD Logs devices had experienced prior revocations by the FMCSA and had subsequently been reinstated.
The FMCSA clarified that these ELDs were placed on the Revoked Devices list due to the failure of the respective companies to meet the minimum requirements outlined in 49 CFR part 395, subpart B, appendix A. This section delineates the “functional specifications” mandated for ELDs.
Carriers and drivers utilizing the revoked devices are mandated to discontinue their use immediately and revert to either paper logs or logging software to record the requisite hours of service data. Furthermore, they are required to replace the revoked ELDs with a compliant device by April 28.
If the identified deficiencies for these ELDs are rectified by the providers within the 60-day period, the FMCSA will reinstate them on the list of registered devices, and the industry will be duly informed of the update.
During this 60-day period, safety officials are advised not to cite drivers using the revoked ELDs for “No record of duty status” or “Failing to use a registered ELD.” Instead, inspectors should request the driver’s paper logs, logging software, or use the ELD display as an alternative method to review the hours of service data, according to the FMCSA.
However, as of April 28, any carrier or driver still utilizing a revoked device will be considered to be operating without a valid ELD.
