The Federal Motor Carrier Safety Administration (FMCSA) recently announced the removal of Falcon ELD and KSK ELD from its list of registered Electronic Logging Devices (ELDs).
These ELDs have been placed on the Revoked Devices list due to the providers’ failure to meet the minimum requirements set forth in 49 CFR part 395, subpart B, appendix A (functional specifications for ELDs), effective as of September 14th.
KSK ELD said in an email to CCJ that the revocation is “an FMCSA mistake” and that the company will provide updates “as soon as [the] situation will be cleared.”
The Federal Motor Carrier Safety Administration (FMCSA) has sent out an industry email regarding the use of the revoked ELDs. It is essential for all motor carriers who currently utilize these revoked ELDs to immediately cease their usage and switch to paper logs or logging software to record Hours of Service (HOS) data.
To ensure compliance, motor carriers must replace their revoked devices with ELDs from the Registered Devices list. This replacement must be completed before November 13, 2023.
Motor carriers have 60 days to replace your revoked ELDs with compliant ones. Once the ELD providers fix any issues, the FMCSA will add them back to the list of registered devices and notify the industry and the field.
“FMCSA strongly encourages motor carriers to take the actions listed above now to avoid compliance issues in the event that the deficiencies are not addressed in time,” the agency said.
During this time, safety officials are encouraged by FMCSA not to cite drivers using the revoked ELDs for 395.8(a)(1) – “No record of duty status” or 395.22(a) – “Failing to use a registered ELD.” Officers should instead request the driver’s paper logs, logging software, or use the ELD display as a back-up method to review the hours-of-service data.
Starting from November 13th, motor carriers who choose to use devices that have been revoked will be considered as operating without an Electronic Logging Device (ELD). In the event that safety officials come across a driver using a revoked device on or after November 13th, they should adhere to 395.8(a)(1) and promptly place the driver out-of-service, as advised by FMCSA.
